Privacy notice

What we collect, why, who sees it, and what you can make us do about it.

Template pending legal review. This notice is a working draft prepared for [LEGAL ENTITY NAME] and should be reviewed by a California attorney before launch. Where a value is highlighted like this, it has to be filled in.

Last updated [DATE].

1. Who we are

This website is operated by [LEGAL ENTITY NAME], trading as Aftermath Rehabilitation, transitional recovery housing in Taft, Kern County, California. In this notice “we” and “us” mean that entity.

2. Being straight about what rules apply

Aftermath Rehabilitation is housing. We are not a treatment center, a detox program, or a clinical facility, and we do not provide diagnosis, treatment or referral for treatment as a service. That means we are generally not a HIPAA covered entity and generally not a program governed by the federal substance use confidentiality rules at 42 CFR Part 2.

We say that plainly rather than claiming protections that do not apply to us, because a promise you cannot keep is worse than an honest description. What does govern us is ordinary California privacy law, the California Consumer Privacy Act as amended, our own house rules, and the fact that we take the confidentiality of the people living here seriously as a matter of basic decency and safety.

If we ever add clinical services, this changes, and this notice will change with it.

3. What we collect

From people enquiring about housing

  • Name, phone number, email address, age
  • Whether you are enquiring for yourself or somebody else, and their relationship to you
  • Broad situation information: where you are living now, how soon you need a bed, your employment situation, what recovery program you are working, what supports you have, and whether there is court or supervision involvement
  • Anything you choose to write in a free-text box
  • The permissions you tick, and when you ticked them

Our forms ask you not to enter diagnoses, medication lists or medical history, and we take anything of that kind on the phone instead. A public web form is not the right channel for health information, and we would rather tell you that than collect it because we can.

From referring professionals

Your name, role, organization and contact details, plus general information about the placement. We ask referrers not to send a client's full name, date of birth or record number through the form.

Automatically

Our hosting provider records ordinary server information (IP address, browser type, the pages requested and when) for security, abuse prevention and reliability. We run no advertising trackers, no analytics profiling and no social media pixels on this site.

4. Why we use it

  • To contact you back about availability, in the way you asked us to
  • To work out whether we can house you, and to point you somewhere better if we cannot
  • To manage the tenancy, the house agreement and rent
  • To keep records of enquiries, consents and referrals
  • To protect the home and the site from abuse

We do not use what you send us to build advertising profiles.

5. We do not confirm that you live here

This is the part that matters most to the people living in the home, so it gets its own section.

We will not tell your employer, your landlord, your family, a journalist, a neighbor or a caller claiming to be your probation officer that you live here, or that you ever contacted us, unless you have given us specific written permission naming that person or agency.

If you want us to confirm residency or provide attendance and compliance letters to a court, a supervising agency, a treatment program or a case manager, we are glad to, and we need that release from you first. You can withdraw it at any time in writing, which stops anything further going out.

The narrow exceptions, which apply to anybody running a home: a genuine emergency where somebody's life is at risk, a valid court order or warrant, and reports the law requires of us such as suspected child abuse or abuse of an elder or dependent adult.

6. Who we share information with

  • Our own staff, limited to the people who need it.
  • Service providers who run the technical parts of this on our behalf under contract: our website host and form processor (Netlify, Inc.) and our email provider. They may only process it for us, on our instructions.
  • People you have named in a release, and nobody else.
  • Where the law compels it, as described above.

We do not pay anyone for referrals and we do not accept payment for making them, so we have no commercial reason to pass your details to anybody.

7. We do not sell your information

We do not sell personal information, and we do not share it for cross-context behavioral advertising, as those terms are used in the California Consumer Privacy Act as amended by the California Privacy Rights Act. We have not done so in the preceding twelve months.

8. How long we keep it

Enquiries that do not lead to a placement are kept for [RETENTION PERIOD] and then deleted. Resident records are kept for [RETENTION PERIOD] after a placement ends, which is driven by tenancy, tax and insurance requirements. You can ask us to delete an enquiry sooner and, unless we are required to keep it, we will.

9. How it is protected

The site is served over HTTPS. Form submissions are held in access-controlled systems and the staff dashboard requires an individual login. Paper files in the home are kept locked. Access is limited to the people who need it.

No system is perfectly secure, and we would rather say so than imply otherwise. That is part of why we ask you to keep sensitive detail off the forms.

10. Your California rights

If you live in California you have the right to know what personal information we have collected about you and where it came from, to access a copy, to correct it, to delete it subject to the exceptions the law allows, to limit our use of sensitive personal information, and to not be discriminated against for exercising any of them.

Using any of these rights will never affect whether we will house you, or your place here if you are a resident.

To use them, call 661-805-0527 or email Eric@aftermathrehabilitation.com. We will verify who you are before acting, because handing somebody's housing enquiry to the wrong person would be a far worse outcome than a slow response. You may use an authorized agent.

11. Calls and text messages

We call or text you only about your enquiry or your placement, and only because you asked us to. Agreeing to be contacted is never a condition of receiving housing or any other service. Message and data rates may apply. Reply STOP to any text to stop them, or tell us on the phone. We send no marketing texts and we do not share your number with anybody.

12. Cookies and tracking

This site sets no advertising or analytics cookies. The staff dashboard sets a login token in the browser so staff stay signed in; that is strictly necessary and is only ever set for staff who log in. We honor Global Privacy Control signals sent by your browser.

13. Children

This housing is for adults. We do not knowingly collect information from anyone under 18. If you believe a child has sent us information, call us and we will delete it.
